Father refused to let son join mother's seaside holiday — court had to step in

A custody dispute between divorced parents in Czechia ended up before the courts after a father refused to hand over his five-year-old son for a planned seaside holiday with the boy's mother. The mother had intended to take the child abroad to the coast in August, but the father would not release the boy — or his passport — in time, forcing the case all the way to the Constitutional Court.

According to the court, the father had known about the August holiday plans since April, yet refused to arrange the handover so the trip could go ahead smoothly. Instead, he scheduled a family celebration for the very same dates. The lower court ruled that the seaside holiday with the mother was in the child's best interests and ordered the father to hand over the boy along with his passport before the scheduled flight.

A last-minute complaint

The father disagreed with the ruling and turned to the Constitutional Court, claiming his rights had been violated. He filed the complaint just four days before the trip was due to start, arguing that the lower court's decision was unfounded and unreviewable, and that the court had sided with the mother, trampling on his right to family life and to raising his son.

Constitutional Court finds no violation

The Constitutional Court panel, led by reporting judge Zdeněk Kühn, found nothing convincing in the father's arguments. According to the published ruling, no flaws were found in the decisions of the lower courts.

"Communication between the parents has broken down to such an extent that they are unable to agree on how to raise their son. The father rejected help from a specialised organisation and from the child's guardian," the judges noted. They also pointed out that the father's claim of having made holiday plans since March was contradicted by a number of facts — including a schedule he himself had submitted to the district court in May, as well as reports from the specialised organisation and the guardian.

"The contested rulings could not have violated the father's right to family life, given that the district court assessed what served the son's best interests. The Constitutional Court therefore dismissed the constitutional complaint as manifestly unfounded," Judge Kühn concluded.
